Waiver of Liability and Covenant Not to Sue
I, the undersigned parent/guardian (hereafter referred to as “UNDERSIGNED”) of the above- named child (hereafter referred to as “CHILD”), hereby release and hold harmless Woodworkers Academy Inc. (hereafter referred to as “COMPANY”), and the woodworking class organizers, instructors, and volunteers (collectively referred to as "the organizers") from any and all liability, claims, demands, losses, or damages, including but not limited to bodily injury, property damage, or emotional distress, arising out of or in any way connected with the child's participation in the woodworking class as detailed below.
I affirm and attest that I am authorized, as a Parent or Guardian, to sign on behalf of the CHILD. I understand that my duty to indemnify and hold harmless is valid regardless of the relationship between the UNDERSIGNED and the CHILD.
1. Acknowledgment of Inherent Risks
The UNDERSIGNED acknowledges that woodworking classes involve inherent risks, including but not limited to the use of power tools, sharp instruments, and other potentially dangerous equipment. The UNDERSIGNED understands that these risks can result in serious injury or death.
2. Assumption of Risk
The UNDERSIGNED agrees to assume all risks associated with the CHILD's participation in the woodworking classes, including the risks mentioned above and any other risks that may arise from participation in this activity.
3. Waiver of Liability
In consideration of the CHILD being allowed to participate in the woodworking classes and enter the property, the UNDERSIGNED hereby releases, waives, discharges, and covenants not to sue the COMPANY, its owners, directors, officers, employees, agents, and volunteers from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the CHILD, or to any property belonging to the CHILD or the UNDERSIGNED, while participating in the woodworking classes or while on the premises where the classes are conducted.
4. Indemnification
The UNDERSIGNED agrees to indemnify, defend, and hold harmless the COMPANY, its
owners, directors, officers, employees, agents, and volunteers from and against any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses, including but not limited to attorney's fees and judgments, arising out of or related to the CHILD's participation in the woodworking classes. This indemnification obligation applies to both first-party claims brought by the UNDERSIGNED or the CHILD and third-party claims brought by any other party. This includes, without limitation, any claims of negligence on the part of the COMPANY or any other claim arising out of or related to the use of the COMPANY's facilities, equipment, or premises.
5. Medical Treatment
The UNDERSIGNED grants permission to the COMPANY to authorize any emergency medical treatment that may be necessary for the CHILD during the participation in the woodworking classes. The UNDERSIGNED agrees to bear any costs associated with such medical treatment.
6. Media Release Waiver
The UNDERSIGNED understands and acknowledges that during my CHILD’s participation in activities with the COMPANY, The CHILD may be photographed or filmed for purposes including, but not limited to, promotional, marketing, or educational use. UNDERSIGNED hereby grants COMPANY the irrevocable right and permission to use, distribute, publish, and display any photographs, video footage, or other media recordings of CHILD, in whole or in part, for any lawful purpose. UNDERSIGNED further understands that all such media shall remain the sole property of COMPANY, and UNDERSIGNED waives any right to inspect or approve the use of the media or to receive any compensation for its use.
7. Binding Effect
This Waiver and Covenant Not to Sue shall be binding upon the heirs, executors, administrators, successors, and assigns of the UNDERSIGNED and the CHILD.
8. Governing Law
This Waiver and Covenant Not to Sue shall be governed by and construed in accordance with the laws of the State of California.
9. Severability
If any provision of this Waiver and Covenant Not to Sue is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be fully effective.
